Terms of Service

1. Agreement

By accessing or using the Thalian platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Thalian is an AI-powered IT intelligence platform that connects to your identity providers, endpoint managers, security tools, and SaaS applications to surface cross-platform insights. The Service includes data collection, AI-driven analysis, finding generation, remediation workflows, and reporting.

3. Accounts and Workspaces

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • Each workspace is a separate tenant environment — data is isolated between workspaces
  • You must be at least 18 years old to use the Service
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy. You may not use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.

5. Plans and Billing

Free Plan

  • Up to 25 identities, 3 integrations, 7-day data retention
  • No credit card required
  • May be subject to usage limits

Pro Plan

  • Up to 500 identities, unlimited integrations, 90-day data retention
  • Billed monthly via Stripe
  • 14-day free trial included for new workspaces

Enterprise Plan

  • Unlimited identities, unlimited integrations, unlimited data retention
  • Custom pricing — contact sales@thalian.ai

Billing Terms

  • Pro subscriptions are billed monthly in advance
  • You may cancel at any time — access continues through the end of the billing period
  • No refunds for partial months
  • If payment fails, the workspace enters a 7-day grace period before downgrading to Free

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

Your Data

  • You retain ownership of all data you provide to the Service ("Customer Data")
  • Customer Data includes identities, applications, devices, entitlements, and integration credentials synced into your workspace
  • We do not sell, share, or use Customer Data for advertising

AI Processing

  • The AI analysis engine processes Customer Data to generate findings and insights
  • AI conversations may be sent to third-party AI providers (Anthropic, OpenAI) for processing
  • AI prompts include workspace context but are not used to train third-party models
  • You can review our AI data handling in the Privacy Policy

7. Security

We implement industry-standard security measures to protect your data:

  • AES-256-GCM encryption for stored credentials
  • TLS 1.2+ for all data in transit
  • Row Level Security on all database tables
  • Role-based access control with six permission levels
  • Immutable, SHA-256 hashed audit logs

8. Integration Credentials

  • When you connect third-party platforms, you authorize Thalian to access your data on those platforms using the credentials you provide
  • Credentials are encrypted at rest and never exposed to frontend clients
  • You are responsible for ensuring the credentials you provide have appropriate permissions
  • You may disconnect integrations at any time, which stops data syncing

9. Intellectual Property

  • Thalian and its licensors retain all rights to the Service, including its software, algorithms, design, and documentation
  • You retain all rights to your Customer Data
  • Findings and analysis generated by the Service based on your data are part of the Service output and may be used by you within your organization

10. Service Availability

  • We target high availability but do not guarantee specific uptime percentages on Free and Pro plans
  • Enterprise plans may include SLA commitments — contact sales@thalian.ai
  • We may perform maintenance that temporarily affects availability, with reasonable notice when possible
  • We are not liable for downtime caused by third-party services (Supabase, Cloudflare, integration platforms)

11. Limitation of Liability

To the maximum extent permitted by law, Thalian, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Thalian does not warrant that the Service will be uninterrupted, error-free, or that findings generated by the AI engine are complete or accurate. The Service is a decision-support tool — you are responsible for verifying findings and making remediation decisions.

13. Termination

  • You may terminate your account at any time by contacting support@thalian.ai
  • We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy
  • Upon termination, your data will be retained for 30 days and then permanently deleted
  • Audit log entries are retained for a minimum of 365 days regardless of account status

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to workspace administrators. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
